DMCA Policy

Overview

Fapph respects the intellectual property rights of others and expects its users to do the same. We respond to valid notices of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and equivalent international copyright laws.

If you believe that content on Fapph infringes your copyright, please follow the process below to submit a takedown notice. We will review all valid notices and act promptly.


How to file a takedown notice

To submit a valid DMCA takedown notice, send an email to [email protected] with the following information:

  1. Identification of the copyrighted work — describe the copyrighted work you claim has been infringed, or provide a list if multiple works are involved
  2. Identification of the infringing content — provide the exact URL(s) on Fapph where the infringing content appears
  3. Your contact information — include your full name, email address, mailing address, and phone number
  4. Good faith statement — a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  5. Accuracy statement — a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf
  6. Signature — your physical or electronic signature

Notices that are missing any of the above elements may not be actioned. We are not able to process notices that do not identify specific URLs.


What happens after you file

Once we receive a valid takedown notice we will:

We aim to process valid notices within 5 business days.


Counter-notice process

If you believe your content was removed in error, you may file a counter-notice. To do so, send an email to [email protected] with the following:

  1. Identification of the removed content — the exact URL(s) of the content that was removed and its location before removal
  2. Your contact information — your full name, email address, mailing address, and phone number
  3. Good faith statement — a statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification
  4. Consent to jurisdiction — a statement that you consent to the jurisdiction of a federal court in your district, or if outside the US, any judicial district in which Fapph may be found
  5. Signature — your physical or electronic signature

If we receive a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action, we may restore the removed content at our discretion.


Repeat infringers

Fapph operates a strict repeat infringer policy. Users who receive multiple valid takedown notices will have their accounts permanently terminated without warning.

We track DMCA notices against user accounts. A pattern of infringement — regardless of whether individual notices are contested — is grounds for permanent removal from the platform.


False or abusive notices

Submitting a DMCA takedown notice with false information is a serious matter. Under the DMCA, any person who knowingly materially misrepresents that content is infringing may be liable for damages, including costs and attorneys' fees.

We reserve the right to disregard notices that we determine in good faith to be abusive, fraudulent, or submitted in bad faith.
